Rule 19
Arrangements for project implementation through negotiation

(1) According to Section 9 of the Act, the person who wants to implement the project through negotiation should submit an application to the Ministry by disclosing the following information:-
(a) Name and address of the applicant,
(b) If the applicant is a company, the name, address, year of establishment of the company, organizational form, ownership and main field of operation, (c) Name, manner and brief description of the project intended to be implemented,
(d) Description of feasibility and feasibility of the project,
(e) Details regarding financial and technical status and experience of the applicant who can implement the project,
(f) Machines, equipment and manpower available to the applicant for the implementation of the project (g) Reasons for implementing the project through negotiations.
(2) While examining the application received under sub-rule (1), the Ministry may request additional documents or details from the applicant if deemed necessary.
(3) If the feasibility and feasibility of the proposed project is seen while examining the application received under sub-rule (1), if the applicant has the financial and technical ability and experience to implement the project and as written in sub-section (3) of section 9 of the Act, the project will be implemented through negotiation. If it is deemed appropriate to do so, the ministry will have to send the details of the received application along with its opinion to the committee.
(4) After examining the details of the application received according to sub-rule (3), the committee shall send its opinion to the Ministry regarding whether the project is suitable to be implemented through negotiation or not.
(5) According to sub-rule (4), if an opinion is received from the committee to implement the project through negotiation, the Ministry shall submit the details of the project to the Government of Nepal for the approval of the project.
(6) After examining the details of the project received according to sub-rule (5), if it is found that the proposed project can be implemented through negotiation, the Government of Nepal will approve the implementation of the project through negotiation.
(7) NEPA to implement the project through negotiation in accordance with sub-rule (6).If approved by the government, the Ministry may request a financial proposal with details as per Section 6, Sub-section (2) of the Act, and the applicant shall submit the details and the financial proposal as per Sub-rule (3) of Rule 15 to the Ministry within the prescribed period. > (8) Upon examining the financial proposal with details received in accordance with sub-rule (7), if it is deemed appropriate to grant approval to the applicant to implement the project, the Ministry shall decide to grant approval and inform the relevant applicant.
